UNCONTESTED SIMPLIFIED DIVORCE
The fixed costs of an uncontested, simplified divorce are as follows:
|Fees chargeable by Commissioner of Oaths||$75|
We are able to offer such low fixed costs for simplified divorce because:
- There is no need for a lawyer to attend Court for simplified divorce proceedings.
- Simplified divorce proceedings only involve paper work, which may be completed by a competent lawyer within a few hours.
- We do not wish to overcharge for work that is largely administrative.
CONTESTED DIVORCE (RESOLVED BY MEDIATION STAGE)
The costs of a contested divorce that is resolved by the mediation stage (or before) will naturally be higher than the costs of an uncontested, simplified divorce.
The additional costs are as follows:
|Proposed Parenting Plan/ Proposed Matrimonial Property Plan||$350|
|Defence and Counterclaim/ Reply and Defence to Counterclaim||$700|
|Status Conference to Update Court on Status of Divorce Proceedings||$350|
|Review of Documents||$350|
|Family Dispute Resolution Conference||$350|
|Mediation 3 Onwards||FREE|
|Court Filing Fees, Disbursements and GST||capped at $800|
Do however note that the additional costs are not fixed at $4,650. It can certainly be lower! If, for instance, a settlement is reached after the proposed parenting and proposed matrimonial property plans are filed, the additional costs may be as low as $350!
The fixed costs of an uncontested annulment are as follows:
|Fees chargeable by Commissioner of Oaths||$25|
We are able to offer such low fixed costs for an uncontested annulment because the work to be done is largely similar to that of an uncontested, simplified divorce. However, in contrast to an uncontested, simplified divorce, the lawyer needs to accompany you to Court on 1 afternoon. Hence, there is an additional cost of $300.
